  1. All memorial posts submitted by users will be under review by the SPCA and will not be published on "petloss.spca.org.hk" immediately after submission. Users will be notified by the SPCA administrator if the post gets approved or rejected.
  2. Users’ memorial posts will be retained on "petloss.spca.org.hk" for one year after the date of publishing. Users will be notified by the SPCA administrator before the post gets taken down.
  3. Any user who creates a memorial post at "petloss.spca.org.hk" must provide true and accurate personal information. If a user provides untrue information, uploads infringing information or publicises abusive (or other types stated at paragraphs 11 and 12 below) message, the user will be held liable for any kind of dispute or consequence arising from such information or message. "petloss.spca.org.hk" has the right to withdraw any services granted and the user must not have any objections.
  4. Users should promptly update the personal data at "petloss.spca.org.hk" if there is any change. Users will be held liable for any kind of consequence (such as removal of registered account and the relevant webpages due to prolonged loss of contact with the user) if they do not promptly update the data at https://petloss.spca.org.hk/.
  5. The information provided by the Society for the Prevention of Cruelty to Animals (Hong Kong) (SPCA ) on "petloss.spca.org.hk" is for a general, indicative purpose only. The SPCA will not be liable for any errors in, omissions from, or misstatements or misrepresentations concerning, whether express or implied, any such information, and will not have or accept any liability, obligation or responsibility. The "petloss.spca.org.hk" service provided by the SPCA is to provide an alternative channel for obtaining the SPCA services. The SPCA will not have or accept any liability, obligation or responsibility whatsoever for any loss, destruction or damage (including without limitation consequential loss, destruction or damage) however arising from or in respect of any use or misuse of, inability to use, or reliance on the electronic services, information uploaded when setting up eWall pages, messages posted on message board and corresponding intellectual property rights of the uploaded information delivered on or via "petloss.spca.org.hk".
  6. The electronic service provided by the SPCA on "petloss.spca.org.hk" is provided on an "AS IS" and "AS AVAILABLE" basis and the SPCA will not have any responsibility for the timeliness, deletion or failure to store any user communications or personalisation settings.
  7. The SPCA cannot guarantee that all records of the deceased can be searched from the database for creating the memorial post at the website. For those deceased whose records cannot be searched during registration, users should provide the SPCA with relevant documents/ proof for facilitating the creation of memorial post at the website.
  8. To facilitate access by users to information provided by or via other parties, "petloss.spca.org.hk" may provide or assist in providing links to external websites through its pages. Provision of, or assistance in providing, these links give rise to no statement, representation or warranty, express or implied, that the SPCA agrees or does not disagree with the contents of any such external sites and the SPCA will not have or accept any liability, obligation or responsibility whatsoever for any loss, destruction or damage (including without limitation consequential loss, destruction or damage) however arising from or in respect of any use or misuse of or reliance on the contents of any such external websites delivered on or via "petloss.spca.org.hk".
  9. Users should refer to the terms and conditions of individual websites when using such information. A user is deemed to have accepted this Terms of Use for "petloss.spca.org.hk" and the terms and conditions of the external websites linked from this website when the user uses such information on those external websites. Permission has to be obtained from the third party owners for the use of the contents and materials on those external websites.
  10. Users should take full responsibility for the user names and passwords provided by "petloss.spca.org.hk" and all activities under the respective user names. The SPCA will not have any liability, obligation or responsibility whatsoever for any loss, reduction, failure to store or transmit or damage of the information when transmitting it to "petloss.spca.org.hk".
  11. Users are responsible for all content that they post on or transmit through "petloss.spca.org.hk". The following content is prohibited:
    • – content that infringes any intellectual property rights, or other proprietary rights of any party;
    • – content that includes any advertisements, solicitations, pyramid schemes, or other commercial elements;
    • – content that is unlawful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
    • – content promoting or providing instructional information about illegal activities; and
    • – content that transmits or contains viruses, corrupted files, or any similar element.

    Your warrant that the contents you posted on or transmitted through "petloss.spca.org.hk" do not and will not infringe any intellectual property rights of any party and you agree to indemnify the SPCA against any allegations or claims of intellectual property rights infringement in relation to such contents.

  12. Users are fully responsible for the messages that they post on this website. If the messages that they post in this website are advertising, commercial, abusive, insulting, disrespectful to the deceased or violated from laws and regulations, the SPCA has the right to delete those messages and to take legal actions, civil and/or criminal, if necessary.
  13. "petloss.spca.org.hk" respects users' personal data privacy and secures users' personal data including name, gender, age group, education level, religious belief and email address except that: – users authorise "petloss.spca.org.hk" to disclose such information; and – any relevant bodies request "petloss.spca.org.hk" to provide users' personal data according to corresponding laws and regulations.
  14. The SPCA examines "petloss.spca.org.hk" content on a regular basis, and it maintains the absolute right (though not the obligation) to remove any content that does not meet the standards listed above. The SPCA also reserves the right to terminate users' access rights to submit content to "petloss.spca.org.hk" if they fail to abide by these terms.
  15. The SPCA maintains the right to do any of the following any time, with or without prior notice:
    • – restricts, suspends, or terminates users' access to all or any part of its services;
    • – changes, suspends, or discontinues all or any part of its services;
    • – refuses, moves, or removes any content.
  16. The SPCA uses an online translation software to translate the Traditional Chinese version of its pages into Simplified Chinese version on "petloss.spca.org.hk". If there is any inconsistency or ambiguity between these two versions, the Traditional Chinese version shall prevail. The SPCA will not have or accept any liability, obligation or responsibility whatsoever for any loss, destruction or damage (including without limitation consequential loss, destruction or damage) however arising from or in respect of any use or misuse of or reliance on the Traditional Chinese version or the translated Simplified Chinese version delivered on "petloss.spca.org.hk".
  17. By using "petloss.spca.org.hk", users agree to accept unconditionally the terms specified in these Important Notices (including Disclaimer, Intellectual Property Rights Notice, Privacy Notice & Terms of Use) and as they may be revised and/or amended from time to time by The SPCA without prior notice to users. Please check this page regularly for any revisions and/or amendments which may be made.
  18. Users shall indemnify the SPCA fully against any claim, demand, compensation,, loss, expense, cost made against or incurred by the SPCA which may arise from or as a result of any use of "petloss.spca.org.hk" whether or not such claim, demand, compensation, loss, expense, cost is caused or contributed to by the users’ negligence or other fault, breach or contravention of any law in using "petloss.spca.org.hk".
  19. The Terms of Use have been translated into Chinese. If there is any inconsistency or ambiguity between the English version and the Chinese version, the English version shall prevail.
  20. "petloss.spca.org.hk" has the final right of interpretation on the above terms.
